Terms of Service

These Terms of Service are a general agreement governing use of FSM Field Service Management and are provided as a plain-language summary of our practices; they are not a substitute for independent legal advice.

1. Acceptance of Terms

By creating an account or otherwise using FSM Field Service Management (“FSM“, the “Service“), operated by Innovative Security Services LLC (“we“, “us“), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

FSM is a multi-tenant, subscription-based field service management platform providing scheduling, client management, estimates and invoicing, service tickets, a price book, billing via Stripe, optional email sending via your own connected Gmail account, and optional integration with Alarm.com.

3. Accounts

You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use.

4. Subscriptions & Billing

Certain features of FSM may require a paid subscription. Billing is processed through Stripe according to the plan you select at sign-up or as otherwise communicated to you. Fees are non-refundable except as required by law or as we otherwise state in writing.

5. Your Data

You retain ownership of the client, job, estimate, invoice, and other business data you enter into FSM (“Your Data“). You grant us a limited license to host, store, and process Your Data solely to provide the Service to you. See our Privacy Policy for details on how we handle information.

6. Acceptable Use

You agree not to use FSM to:

Send unsolicited bulk email or otherwise violate applicable anti-spam laws (including the CAN-SPAM Act) when using the email-sending feature;
Upload or transmit unlawful, infringing, or fraudulent content;
Attempt to access another business’s data or interfere with the security or integrity of the Service;
Use the Service in violation of any applicable law or regulation.

7. Third-Party Services

FSM integrates with third-party services, including Stripe (payments), Google Gmail API (email sending), and Alarm.com (monitoring). Your use of these integrations is also subject to the respective third party’s own terms of service and privacy policy. We are not responsible for the acts or omissions of these third parties.

8. Termination

You may stop using FSM and request account closure at any time by contacting us. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a security risk to the Service or other users. Upon termination, we will delete or anonymize Your Data in accordance with our Privacy Policy, except where retention is required by law.

9. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

10. Limitation of Liability

To the maximum extent permitted by law, Innovative Security Services LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service.

11. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of FSM after changes take effect constitutes acceptance of the updated Terms.
